This document is only applicable for enterprise hosting.
We shall attempt to provide access to the System for twenty-four (24) hours per day, seven (7) days per week throughout the term of your Agreement. From time to time the System may be inaccessible or inoperable for any reason, including, without limitation: (i) equipment malfunctions; (ii) periodic maintenance procedures or repairs that we may undertake from time to time; or (iii) causes beyond our control or that are not reasonably foreseeable by us, including, without limitation, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network congestion or other failures.
You agree that we have no control of availability of the System on a continuous or uninterrupted basis.
We offer a service uptime guarantee for the System of 100% of available time. If we fail to maintain this level of service availability, you may contact us and request a refund of 5% of your monthly hosting fee for each 30 minutes of downtime, up to 100% of your monthly hosting fee for that month. The refund does not apply to service interruptions caused by: (i) periodic scheduled maintenance or repairs we may undertake from time to time; (ii) errors caused by you, including your custom scripting or coding or any security breach caused by you or anyone who gained access to our system through your account; (iii) causes beyond our control or that are not reasonably foreseeable by us; and (iv) outages related to the reliability of certain programming environments. Total service uptime shall be solely determined by us and shall be calculated on a monthly basis.
